User Agreement

This User Agreement (“Agreement”) is a legally binding contract between you (“User”, “you”, or “your”) and BoffinGeeks, an entity incorporated under the laws of India (“PickUrJob”, “we”, “us”, or “our”), governing your access to and use of the PickUrJob website located at https://www.pickurjob.com (the “Platform”) and related services.

1. About PickUrJob (Platform Role)
PickUrJob is an online marketplace platform that enables clients (“Clients”) and independent service providers (“Freelancers”) to find each other and enter into service contracts directly.

- Is not a party to any agreement between Clients and Freelancers
- Is not an employer, employee, agent, or partner of any User
- Does not supervise, direct, or control the work performed
- Does not guarantee the quality, safety, or legality of services
All service contracts are entered into solely between Clients and Freelancers.
2. Eligibility & Account Registration
To use the Platform, you must:
- Be at least 18 years old
- Have the legal capacity to enter into contracts
- Provide accurate, current, and complete information
You are responsible for:
- Maintaining account security
- All activities conducted through your account
- Keeping your login credentials confidential
PickUrJob may suspend or terminate accounts that provide false information or violate this Agreement.
3. Service Contracts Between Users
When a Client and Freelancer agree to work together, they enter into a separate service contract (“Service Contract”).
Unless otherwise agreed by the Users:
- Freelancers act as independent contractors
- No employment, partnership, or agency relationship is created
- Users determine scope, pricing, timelines, and deliverables
PickUrJob may provide default contract frameworks for convenience, but Users remain free to agree to different terms between themselves.
4. Payments, Fees & Escrow-Like Mechanism
4.1 Third-Party Payment Processing
All payments on PickUrJob are processed through third-party payment service providers. PickUrJob does not hold banking licenses and does not provide banking or escrow services.
4.2 Fixed-Price Funding
For fixed-price contracts:
- Clients may be required to fund the agreed amount upfront
- Funds are held by third-party payment providers
- PickUrJob facilitates release based on User actions and platform rules
4.3 Auto-Release
If no dispute is raised, funds may be automatically released to the Freelancer after 7 working days from submission or completion, as applicable.
4.4 Platform Fees
PickUrJob may charge:
- A Freelancer service fee (currently 10%)
- Client fees (if applicable, disclosed separately)
Fees are non-refundable, except where required by law.
5. Disputes & Platform-Led Mediation
If a dispute arises between Users:
- Users should first attempt to resolve it directly
- PickUrJob may offer platform-led mediation on a best-effort basis
Important:
- PickUrJob does not guarantee resolution
- Mediation is non-binding
- Final responsibility remains with the Users
PickUrJob may take reasonable actions such as pausing payments during dispute review.
6. Intellectual Property
Unless otherwise agreed in writing:
- Upon full payment, the Client receives ownership of the agreed work product
- Freelancers warrant that work delivered does not infringe third-party rights
- Pre-existing tools, frameworks, or background materials remain with their original owner
7. User Conduct
Users agree not to:
- Misrepresent identity or qualifications
- Circumvent the Platform to avoid fees
- Post illegal, fraudulent, or misleading content
- Harass, discriminate, or abuse other Users
- Infringe intellectual property rights
Violation may result in suspension or termination.
8. Non-Discrimination & Accessibility
PickUrJob is committed to providing equal access and does not tolerate unlawful discrimination or harassment.

3.5 Platform Misuse
- Attempting to interfere with Platform operations
- Introducing malware or malicious code
- Scraping, copying, or reverse-engineering Platform systems
- Using automated tools without authorization
4. Job Postings & Proposals
Clients agree to:

- Not solicit illegal or unethical services
- Review proposals fairly
Freelancers agree to:
- Submit truthful proposals
- Not spam Clients
- Accept work only when qualified to perform it
5. Communications

1. Platform Role in Payments
PickUrJob is a technology platform that facilitates payments between Clients and Freelancers.
PickUrJob:
- Is not a bank
- Is not a licensed escrow agent
- Does not provide financial, fiduciary, or trust services
- Does not take ownership of User funds
All payments are processed and held by third-party payment service providers in accordance with their own terms and applicable laws.
2. Payment Methods
Users may pay for services using payment methods made available on the Platform through third-party payment service providers.
Availability of payment methods may vary by:
- Country
- Currency
- User verification requirements
- Regulatory restrictions
PickUrJob does not guarantee availability of any specific payment method at all times.
3. Fixed-Price Contracts & Upfront Funding
For fixed-price Service Contracts:
- Clients are required to fund the agreed amount upfront before work begins

- PickUrJob facilitates release of funds based on Platform rules and User actions
Funding a fixed-price contract constitutes the Client’s authorization to release funds in accordance with this Policy.
4. Submission, Approval & Auto-Release
4.1 Submission
When a Freelancer submits completed work:
- The Client is notified through the Platform
- The review period begins
4.2 Client Actions
Within the review period, the Client may:
- Approve the work (funds released)
- Request revisions
- Raise a dispute
4.3 Auto-Release
If the Client takes no action and no dispute is raised, funds may be automatically released to the Freelancer after 7 working days.
Auto-release is intended to ensure timely payment and reduce payment delays.
5. Disputes & Payment Holds
If a dispute is raised before fund release:
- PickUrJob may temporarily pause fund release
- Users are encouraged to resolve disputes directly
- PickUrJob may provide platform-led mediation on a best-effort basis
Important:
- Mediation is non-binding
- PickUrJob does not make legal judgments
- PickUrJob does not guarantee dispute outcomes
Funds will be released or refunded based on:
- Mutual User agreement, or
- Completion of the dispute process, or
- Applicable legal requirements
6. Refunds
Refunds may occur only in limited circumstances, such as:
- Mutual agreement between Client and Freelancer
- Platform-determined resolution after mediation
- Legal or regulatory obligations
Platform fees, payment processing fees, and other charges may be non-refundable, except where required by law.
7. Fees & Deductions
PickUrJob may deduct:
- Freelancer service fees (currently 10%)
- Client fees (if applicable)
- Payment processing fees charged by third-party providers
Fees and applicable rates are disclosed on the Platform or in the Fees & Authorization Policy.
8. Authorization & User Instructions
By using the Platform, Users authorize PickUrJob to:
- Initiate payment instructions to third-party payment service providers
- Facilitate release, withholding, or refund of funds according to this Policy
- Deduct applicable fees
Users acknowledge that payment actions taken through the Platform constitute binding instructions.
9. Currency & Exchange Rates
Payments may be processed in different currencies.
Users acknowledge that:
- Exchange rates are determined by third-party payment service providers
- Conversion fees may apply
- PickUrJob does not control exchange rates
10. Taxes
Users are solely responsible for:

PickUrJob Service Contract Framework

PickUrJob, operated by BoffinGeeks, is not a party to any Service Contract.
1. Parties & Relationship
Each Service Contract is entered into solely between:
- The Client, who requests services; and
- The Freelancer, who provides services.
Independent Contractor Status
- Freelancers act as independent contractors
- Nothing creates an employment, partnership, agency, or joint venture relationship
- Freelancers are not entitled to employee benefits, insurance, or protections from Clients or PickUrJob
2. Scope of Services
Each Service Contract must clearly define:
- Description of services
- Deliverables
- Timeline
- Pricing (fixed-price or hourly)
- Any milestones, if applicable
Freelancers control the manner and means of performing services, subject to Client requirements agreed in the Service Contract.
3. Contract Types
3.1 Fixed-Price Contracts
- Client and Freelancer agree on a total price
- Client funds the amount upfront via the Platform
- Payments are released in accordance with the Payments & Escrow Policy
- Unless otherwise agreed, fixed-price contracts continue until completion or termination
3.2 Hourly Contracts
- Services are billed based on an agreed hourly rate
- Billing periods and approval mechanisms are defined on the Platform
- Freelancers may bill only for actual time spent on Client work
PickUrJob does not require screen recording, tracking software, or surveillance tools unless explicitly introduced in the future.
3.3 Bonuses & Expenses
- Clients may optionally offer bonuses or reimburse expenses
- Such payments are subject to Platform rules and approvals
- Bonuses and expenses do not modify the underlying Service Contract unless stated
4. Payments & Fees
- Payments are processed through third-party payment service providers
- PickUrJob facilitates payment release based on Platform rules
- Platform fees may be deducted before Freelancer payouts
PickUrJob does not guarantee payment beyond the terms of the Service Contract and Platform policies.
5. Client Responsibilities
Clients agree to:
- Provide clear and lawful requirements
- Review submissions in good faith
- Pay for completed work as agreed
- Not request unlawful, unethical, or infringing work
6. Freelancer Responsibilities
Freelancers agree to:
- Perform services professionally and competently
- Deliver original work unless otherwise agreed

7. Intellectual Property Rights

1. Platform Fees Overview
PickUrJob charges fees for facilitating access to the Platform, payment processing, and related services.

All applicable fees are disclosed on the Platform or in related policies before a transaction is completed.
2. Freelancer Service Fee
- PickUrJob currently charges a Freelancer Service Fee of 10%
- The fee is calculated on the total amount paid by the Client under a Service Contract
- The fee is deducted before funds are released to the Freelancer
PickUrJob reserves the right to change the Freelancer Service Fee in the future with prior notice.
3. Client Fees
PickUrJob may charge Clients certain fees, such as:
- Marketplace or platform usage fees
- Contract-related fees
- Other service-related charges
Client fee rates and structures are configurable and will be disclosed on the Platform when applicable.
No Client fee is charged unless clearly communicated before the Client confirms payment.
4. Payment Processing Fees

This Data Processing Addendum (“DPA”) forms part of the PickUrJob User Agreement and applies where BoffinGeeks (“PickUrJob”, “we”, “us”, or “our”) processes Personal Data on behalf of a User in connection with the use of https://www.pickurjob.com (the “Platform”).

3. Scope & Purpose of Processing
PickUrJob processes Personal Data only to:
- Operate and maintain the Platform
- Facilitate Service Contracts between Users
- Process payments through third-party payment service providers
- Provide customer support
- Prevent fraud, abuse, and security incidents
- Comply with legal obligations
PickUrJob does not process Personal Data for purposes outside those described in this DPA.
4. User Instructions
Where PickUrJob acts as a Processor:
- Personal Data is processed only on documented instructions from the User
